M.L. Wilkins & Son Ltd. (CCAA)

IN THE MATTER OF A PLAN OF COMPROMISE OR ARRANGEMENT OF THE APPLICANT M.L. WILKINS & SON LTD. PURSUANT TO THE COMPANIES' CREDITORS ARRANGEMENT ACT

On October 29th, 2007, M.L. WILKINS & SON LTD.(the "Company") of 819 Royal Road, Fredericton, New Brunswick, made application to the Court pursuant to the Companies's Creditors Arrangement Act (the "CCAA").

The stay of proceedings under the CCAA was terminated with respect to the Business Development Bank of Canada ("BDC") on February 15, 2008 and with respect to all other creditors on March 5, 2008 as no plan of arrangment or compromise had been filed. On or about February 15, 2008, BDC appointed a receiver who took possession of substantially all of the real property and chattels owned by the Company. Further, on March 18, 2008, a receiving order was issued by the Court adjudging the Company bankrupt.
