Long Fertilizers Limited and Long Potato Growers Limited (CCAA)
IN THE MATTER OF A PLAN OF COMPROMISE OR ARRANGEMENT OF THE APPLICANTS LONG FERTILIZERS LIMITED AND LONG POTATO GROWERS LIMITED PURSUANT TO THE COMPANIES' CREDITORS ARRANGEMENT ACT
On May 28th, 2008, Long Fertilizers Limited and Long Potato Growers Limited (the "Companies") of 495 rue Principale, Clair, New Brunswick, made application to the Court pursuant to the Companies's Creditors Arrangement Act (the "CCAA").
On January 21, 2009, the Companies consented to the issuance of a Court Order terminating the stay of proceedings under the CCAA, effective at 12:00 noon on January 22, 2009. As a result, creditors were no longer stayed from taking action. It is the Monitor's understanding that the Royal Bank of Canada shortly thereafter appointed a receiver in respect of the property, assets and undertakings of Long Fertilizers Limited. It is further the understanding of the Monitor that Long Potato Growers Limited, shortly after the lifting of the CCAA stay, sought relief under the Farm Debt Mediation Act.
The Monitor was discharged by the Court on March 20, 2009.
